Separation, breakdown or divorce of an EEA(EU) national and non-EEA spouse.
The provisions of the Immigration (EEA) Regulations 2006 now allow non-EEA nationals of EEA(EU) nationals to remain in the UK following either separation, permanent breakdown or divorce with EEA(EU) nationals.
You must have been married for at least 3 years and have lived, both you and your EEA(EU) spouse/partner, in the UK for at least 12 months. If you have been married for 3 years at lived and worked in the UK for at least 12 month out of those 3 years and your separate, your marriage breaks down or you even divorce, you can now remain in the UK on your won and separately from your EEA(EU) spouse under Retention of EEARight of Free Movement Direction of the above Regulation.
